Student Government elections for executive alliances are postponed for two weeks after former SG presidential candidate Madison Gardner was granted a restraining order against UT on Tuesday in the Travis County District Court.
Judge Tim Sulak heard Gardner’s request for an injunction on the grounds that Gardner’s freedom of association and freedom of speech rights under the First Amendment were violated after the Election Supervisory Board disqualified the Madison and Antonio campaign on Feb. 22. Madison and his running mate Antonio Guevara were disqualified for associating themselves with Student Events Center presidential candidate Carissa Kelley in a promotional photo for their campaign.
Although Madison told The Horn on Monday that they “may” file a lawsuit, Madison had already spoken with his lawyer at this time, who said during the hearing that he called the courts that same afternoon to notify them of their intention to file on Tuesday. Madison’s lawyer requested that their case be expedited and heard as soon as possible due to the election timeline.
During the hearing, presidential candidate John Lawler protested postponing elections and allowing Gardner an opportunity to put his name back on the election ballot, citing that Gardner and Guevara have continued to illegally campaign after their disqualification. Lawler also said that Gardner was one of the people who helped write the Election Code, and used this very same code to disqualify former candidate Yaman Desai and running mate Whitney Langston.
“If [the postponing] goes forward now it would severely impact the race,” said Lawler. “I don’t have money to run another campaign.”
Although Judge Sulak acknowledged these inequities, he said that potential imminent harm to all those involved called him to make the judgment to postpone the elections and allow time for Gardner to take his case to a higher court.
“That’s unfortunate,” Lawler said.
Elections for all other candidates will proceed on Feb. 29 and March 1, said the Election Supervisory Board. Only the President and Vice President elections will be postponed until further notice.
